Service.

These terms govern your access to and use of SparkCut’s video clipping, AI, and publishing tools.

1. Accepting these terms

By accessing or using SparkCut, you agree to these Terms and our Privacy Policy. If you use SparkCut for an organization, you represent that you are authorized to accept these Terms for that organization. If you do not agree, do not use the service.

2. Eligibility and accounts

You must be legally able to enter into these Terms and meet any minimum age required in your location. You are responsible for accurate account information, protecting credentials, and all activity under your account.

3. Your content and permissions

You retain ownership of content you submit. You grant SparkCut a limited, worldwide license to host, copy, process, modify, and transmit that content only as needed to operate and improve the service. You represent that you own or have all rights and permissions needed to upload, edit, and publish the content, including music, likeness, privacy, publicity, and intellectual-property rights.

4. AI-generated output

SparkCut may suggest clips, scores, captions, descriptions, hashtags, and edits using automated systems. Output may be inaccurate, incomplete, similar to other output, or unsuitable for your audience. You must review and approve output before use. SparkCut does not guarantee views, engagement, revenue, or virality.

5. TikTok publishing

You control what is sent to TikTok. SparkCut will initiate a posting action only after the required authorization and your express approval. You are responsible for selecting privacy and interaction settings, reviewing descriptions and disclosures, and following TikTok’s terms, music rules, branded-content policies, posting limits, and community guidelines. TikTok may delay, restrict, reject, or remove content independently of SparkCut.

6. Acceptable use

You may not use SparkCut to infringe rights; upload content without permission; impersonate others; deceive viewers; distribute unlawful, abusive, exploitative, or malicious material; evade platform restrictions; manipulate engagement; scrape services; introduce malware; probe security; interfere with operations; or resell access without written permission.

7. Third-party services

SparkCut may integrate with TikTok, YouTube, and other providers. Those services are governed by their own terms and may change or discontinue functionality. SparkCut is not responsible for third-party platforms, content, policies, availability, or actions.

8. Service changes and availability

We may add, modify, suspend, or discontinue features, limits, or integrations. The service may experience interruptions or errors. We may restrict access when reasonably necessary for security, maintenance, legal compliance, or abuse prevention.

9. Suspension and termination

You may stop using SparkCut at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, fail to pay applicable fees, or misuse the service. Provisions that by their nature should survive termination will remain effective.

10. Disclaimers

To the fullest extent permitted by law, SparkCut is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

11. Limitation of liability

To the fullest extent permitted by law, SparkCut and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or opportunities arising from use of the service.

12. Changes and contact

We may update these Terms by posting a revised version and effective date. Continued use after an update means you accept the revised Terms. For questions, contact SparkCut Support through the support channel provided in the service.
